Appeal Process & Petition for Redetermination

Please do not attempt to file a Petition for Redetermination until you receive your fee bill.

If you are the property owner who received a Fire Prevention Fee billing, you may petition for a redetermination of whether the fee amount was correctly calculated. The Petition must be filed within 30 days from the mailing date shown on the billing notice pursuant to Public Resources Code section 4220.

The Petition must be based on whether the fee as specified in Public Resources Code Section 4213 et seq. applies to the specific property for which the Petition was filed. The Petition must be in writing stating the specific grounds upon which the Petition is founded and should include supporting documentation. Filing a Petition for Redetermination will not prevent the accrual of interest. Examples of conditions under which you may file a Petition for Redetermination are:

  • Whether your structure is actually located in the SRA;
  • The number of habitable structures on your parcel that should be charged the fee;
  • Inclusion of the $35 per structure credit amount for a location within an area that receives local fire protection services and the related fee amount calculated;
  • An error in the calculation of the fee.

Decision Process & Timeline

Once your Petition for Redetermination is received by the Fire Prevention Fee Service Center, a letter will be sent to you in the mail acknowledging your submittal.

By law, CAL FIRE is required to review and make a determination on your Petition within 60 days of the date of submittal. Once CAL FIRE reaches a decision regarding a submitted Petition, notification will be sent to the petitioner regarding the outcome, as well as any further action required by the petitioner.
